GENERAL & ADDITIONAL SERVICES: The quoted amount is based on the current itinerary and is valid for 7 days. Client’s authorized signature on this document will serve as the confirmation for the route and aircraft specified under select Quote Number and as Client’s acceptance of the terms and conditions stated below. Client assumes all financial responsibility for the grand total amount quoted PLUS any unanticipated, unforeseen or unknown charges, including without limitation those resulting from Client/passenger-requested changes in routing, excessive APU charges, de-icing, additional landing or international handling fees, special requests, flight phone, WIFI, and catering or ground transportation. WIFI charges are based on data usage. The client will be responsible for any ground services deemed necessary by the flight crew, such as hangar or de-icing fees, for flight safety. The total amount of additional services will be billed to client.

DAMAGE TO AIRCRAFT: Client will pay for all reasonable costs and expenses to clean, repair or replace any property or cabin fixture damaged due to the negligence or misconduct of Client or passengers. Damage not considered normal wear and tear shall include, but is not limited to, such items as: upholstery stains, broken plate/glassware, broken drawers, torn seats or headliner, food or drink spills which require professional cleaning. While pets may be allowed on a case by case basis, they must be kenneled or restrained for safety of flight purposes and the Client is responsible for resulting damages or stains. Client must disclose the presence of pets onboard a flight at time of booking. If Client should arrive at the aircraft with pets that Right Lane Aviation was not advised of prior to, Right Lane Aviation reserves the right to terminate the flight with a 100% cancellation penalty. A cleaning fee of $1500.00 will incur for pets per flight if deemed necessary. Smoking is prohibited on all Right Lane Aviation flights. Each client/passenger must provide government issued identification prior to boarding the flight.

Unless otherwise stated on the quote, CANCELLATION TERMS are as follows:

1.) Domestic trip during non-holiday periods: Cancellation within 72 hours of the scheduled departure is subject to a charge of 25% of the quoted amount. Cancellation within 48 hours of the scheduled departure is subject to a charge of 50% of the quoted amount and cancellation within 24 hours of the scheduled departure is subject to a charge of 100% of the quoted amount. 

2.) International trip during non-holiday periods: Cancellation within 14 days of the scheduled departure is subject to a charge of 25% of the quoted amount. Cancellation within 7 days of the scheduled departure is subject to a charge of 50% of the quoted amount and cancellation within 72 hours of the scheduled departure is subject to a charge of 100% of the quoted amount.

3.) Holidays periods are defined as, 3 days prior to, through 3 days following, Martin Luther King Jr. Day, Presidents Day, Memorial Day, Independence Day (July 4th), Labor Day and Columbus Day. 5 days prior to, through 5 days following, Thanksgiving, Christmas and New Year’s Day. If the trip itinerary falls within any of the previous days listed, the cancellation penalty will be as follows: If cancelled within 14 days of departure 50% of the quoted amount will be due. If cancelled within 7 days of departure 100% of the quoted amount will be due.

4.) Cancellation of any one-way itinerary, including multi-leg routes, at any time after confirmation, is subject to a 100% cancellation penalty. If client is either a “NO SHOW” or more than 2 hours late after the scheduled departure time, Right Lane Aviation reserves the right to terminate the flight with a 100% cancellation penalty. 6. In addition to cancellation charges, all cancellations, regardless of when they occur, are subject to payment of any actual expenses incurred by Right Lane Aviation.

DELAY, DIVERSION, OR TERMINATION OF TRIP:

Client acknowledges and agrees that a charter trip may be delayed, diverted, or terminated under certain circumstances, including but not limited to adverse weather conditions, operational limitations, airport ground holes, mechanical failure or a Safety of Flight determination. The aircraft operator, and the pilot-in-command will be in complete charge and control of the aircraft at all times. If, in the pilot-in-command’s sole judgment, safety of flight may be jeopardized, then he/she may terminate or refuse to commence a flight (a Safety of Flight determination). Except for a delay, diversion, or termination caused by the Client or any passengers, if a trip is delayed, diverted, cancelled, or terminated prior to completion, including because of a Force Majeure or Safety of Flight determination, then Client will only be charged for the cost attributable to transportation actually performed and such transportation as may be necessary to return charter passengers to their original airports of departure, if they so elect to return. If Client requests that Right Lane Aviation arrange for a replacement charter aircraft to complete Client’s scheduled itinerary, Client agrees to pay for such replacement aircraft costs, including any additional cost for positioning the replacement aircraft to or from Client’s departure or arrival location. Client is responsible for all de-icing costs & WIFI charges.

PAYMENT: Payment is due in 10 days in advance of the date of travel unless other arrangements have been agreed to in writing by Right Lane Aviation. All payments need to be made by electronic bank wire. Additional charges listed under the “Additional Services” section will be billed to client including a cash-discount of 5%. Charges not paid when due will accrue interest at 15% per annum and a collection fee assessed at 5% of the unpaid balance. With your authorized signature, you hereby agree to be responsible for any additional charges resulting from changes in the itinerary, additional flight time, landing fees, overnights, standby, actual international fees, de-icing, hangar fees, WIFI, and other flight related charges. All additional services arranged on behalf of the Client will be billed upon completion of the flight.

INTERPRETATION AND LAW: This Agreement will be governed by the laws of the State of New York. The flight or flights specified in the itinerary will be operated in compliance with all Federal Aviation Administration (FAA) and Department of Homeland Security (DHS) regulations, and must adhere to the TSA prohibited items list (www.tsa.gov). 

OPERATIONAL CONTROL, AGENCY, AND INSURANCE: The flight or flights specified in the itinerary will be managed by Right Lane Aviation and the direct air carrier will have operational control. If the specified aircraft for the flight is unavailable, Right Lane Aviation reserves the right to provide a replacement aircraft within the same category.  If the above-mentioned aircraft is not available for the flight, by signing below, Client expressly authorizes and appoints Right Lane Aviation to act as Client’s agent in contracting for the flight(s), which shall be subject to the terms and conditions contained herein. The direct air carrier operating the flight is required to carry liability insurance. Please contact us if you would like additional information on the liability limits for this specific aircraft.  Client represents and warrants it is the end user of this flight and will not resell this flight’s capacity in whole or in part. All passengers are required to provide a valid form of government- issued photo ID prior to boarding each flight.

Damage not considered normal wear and tear shall include, but is not limited to, upholstery stains, broken plates/glassware/trays, broken tables/drawers, torn seats or headliner, food or drink spills which require professional cleaning. Any client choosing to travel with a pet onboard must inform Right Lane Aviation at time of booking. If Client fails to provide such notice, Right Lane Aviation reserves the right to terminate the flight with a 100% cancellation penalty. While pets may be allowed on a case by case basis, they must be kenneled or restrained during flight for safety purposes and the Client is responsible for any damages or stains caused by the pet. Smoking and use of e-cigarette devices are prohibited on all Right Lane Aviation flights. The pilot-in-command reserves the right to terminate a flight due to any passenger behavior he/she deems unacceptable, inappropriate, or unsafe. The Client, in addition to all passengers, must provide government issued identification prior to boarding the flight.

3) Holiday periods are defined as (MAYBE DO A TABLE) a) 3 days prior to, until 3 days following: Martin Luther King Jr. Day, Presidents Day, Memorial Day, Independence Day (July 4th), Labor Day and Columbus Day. b) 5 days prior to, until 5 days following: Easter, Christmas, and New Year’s Day. c) If the trip itinerary falls within any of the days listed above, cancellation within 14 days of departure will incur a penalty of 50% of the quoted amount, and cancellation within 7 days of departure will incur a penalty of 100% of the quoted amount.

4) Cancellation of any one-way itinerary or multi-leg route, at any time after signing quote, is subject to a 100% cancellation penalty. On the travel date, if Client fails to arrive, or arrives more than 2 hours after the scheduled departure time, Right Lane Aviation reserves the right to terminate the flight with a 100% cancellation penalty. In addition to cancellation charges, all cancellations, regardless of when they occur, are subject to payment of any actual expenses incurred by Right Lane Aviation.

DELAY, DIVERSION, OR TERMINATION OF TRIP:
Client acknowledges and agrees that a charter trip may be delayed, diverted, or terminated under certain circumstances, including but not limited to, adverse weather conditions, operational limitations, airport ground holes, mechanical failures, avionic complications, or a Safety of Flight determination. The aircraft operator and the pilot-in-command will be in complete charge and control of the aircraft at all times. The pilot-in-command has the right to terminate any flight that he/she deems unsafe. Such a determination is subject to the sole judgement of the pilot-in-command. Except for a delay, diversion, or termination caused by the Client or any passengers, if a trip is delayed, diverted, cancelled, or terminated prior to completion, including because of a Force Majeure or Safety of Flight determination, then Client will only be charged for the cost attributable to transportation actually performed and such transportation as may be necessary to return charter passengers to their original airports of departure, if they so elect to return. If Client requests that Right Lane Aviation arrange for any additional transportation to complete Client’s scheduled itinerary, Client agrees to pay for such additional transportation, including any additional cost for positioning a replacement aircraft to or from Client’s departure or arrival location.
PAYMENT: Payment is due upon signature of quote and shall be made no later than 14 days prior to departure date. Right Lane Aviation reserves the right to terminate the flight if Client fails to pay within the stated time limit. All payments must be made by electronic bank wire. Upon signature of quote, Client agrees to be responsible for any additional charges resulting from changes in itinerary, additional flight time, landing fees, overnights, standby, actual international fees, de-icing, hangar fees, WIFI, and other flight related charges.
APPLICABLE LAW
This Agreement shall be governed by, and construed and interpreted in accordance with, the laws of the State of New York, the laws of which the Client hereby expressly elects to apply to this Agreement, without giving effect to provisions for choice of law thereunder.
NON-CIRCUMVENTION
Client agrees that it will not directly or indirectly conduct business with any owner, controller, or operator of the Aircraft(s) provided under this Agreement for a period of two (2) years following the last day of the itinerary set forth in the quote. The parties agree that a breach of this provision shall entitle Right Lane Aviation to 25% of the total of all charter fees and charges payable to such owner, controller or operator of such Aircraft(s) for all charters directly or indirectly undertaken by Client, or any principals or agents of Client, during the stated restriction period.
FINAL DISCLAIMER:
Right Lane Aviation, operated alongside Right Lane Management by Kenneth G. Lane, is an air charter broker, not a direct air carrier, and does not own or operate any aircraft. All flights will be operated by properly licensed U.S. or foreign air carriers. All services are subject to the terms and conditions set forth above.
